I think that the question of the liberty of people involved in the inquiry before the Court of Appeal judgment is known would be dealt with in that way. After the Court of Appeal freed Angela Cannings—in a criminal case—we had the opportunity to set about identifying any further relevant cases, and our first port of call was the Prison Service. It has been more straightforward for us to try to identify and review such serious and consequential cases. Identifying those cases is more complex, as is determining the procedure for their review. In criminal cases, appeals can be made to the Court of Appeal criminal division, and we also have the Criminal Cases Review Commission. The process of how to go about a review in family cases is now being considered. The judgment that I have quoted makes clear what is at issue, but the process of identifying cases—and the machinery that should be used to remedy miscarriages of justice—is not straightforward.
